PROTECTIVE COVENANTS
LIDDON HILLS, PHASE 1
WHEREAS, the sole owners and developers
of that certain tract of land known and described as LIDDON HILLS,
Alcorn County, Mississippi, desire to establish certain building
and occupancy standards on said property for the protection and
benefit of any present or future owner of any portion of said property,
THEREFORE, in consideration of the
premises and the benefits to persons now owning said property and
to persons who may acquire an interest in the same, the following
conditions and restrictions of right are hereby placed on said property
as fully and completely as if included in words and figures on the
plat of said land at the time of recording said lots in the land
records of Alcorn County, Mississippi:

1) TERM. These covenants are to run with the land and shall be binding
on all parties and all persons claiming under them until the 31st
day of May, 2016, at which time said covenants shall be automatically
extended for successive periods of ten (10) years unless by a vote
of the then owners of the lots, it is agreed to change said covenants
in whole or in part.
2.) POWER OF COVENANTS. If the parties
hereto, or any of them or their heirs or assigns, shall violate
or attempt to violate any of the covenants herein, it shall be lawful
for any other person or persons owning any real property situated
in said development or subdivision to prosecute any proceedings
at law or in equity against the person or persons violating or attempting
to violate any such covenant, and either prevent him from doing
so or to recover damages or other dues for such violation. All court
costs and attorneys fees incurred in such action shall be charged
to the unsuccessful litigant.
3.) TYPE OF LOTS. All lots in the
tract shall be known and described as residential lots, and no lot
shall be resubdivided, but shall remain as shown on the recorded
plat. However, when two or more adjoining lots are sold to the same
owner, the intervening boundary line may then be voided and the
two or more lots shall become one.
4.) MINIMUM HOME SIZE. No dwelling
of one story shall be erected on the tract unless it contains 1,800
or more square feet of finished and heated living area, and no dwelling
of one-and-one-half or two stories shall be erected on the tract
unless it contains 1,500 or more square feet of finished and heated
living area on the ground floor. No dwelling of split-level or other
multiple-floor construction shall be erected on the tract unless
it contains 1,800 or more square feet of perimeter area measured
at the finished grade of the house.
5.) BUILDING SETBACKS. No building
shall be located nearer than thirty-five (35) feet to a front lot
line, or nearer than thirty (30) feet to a side street line. No
building or portion thereof shall be located nearer than ten (10)
feet to any side lot line, or nearer than ten (10) feet to a back
lot line or the shore of a lake. The restrictions in this paragraph
number 5 may be waived or changed by the developer or its assigns
in the portion of Liddon Hills located only in Alcorn County, but
the portion located in the city will have to comply with current
building restrictions as established by the City of Corinth.
6.) OUT-BUILDING LIMITATIONS. No outbuilding
shall be built which is larger that 1,500 square feet (this requirement
may be waived on an individual lot basis by the Liddon Hills Architectural
committee).
7.) UTILITY EASEMENTS. All lots in
Liddon Hills Subdivision shall be subject to a Utility Easement,
for the installation, maintenance, and repair of underground utilities.
This easement shall be twenty (20) feet from the curb or edge of
the street, (except for Lots #1 and #2, where the utility easement
is thirty-five (35) feet from the curb or edge of the street) and
ten (10) feet on each of the side and rear lot lines for lots adjoining
streets (both public and private).
